BLAST and another vs. Bangladesh and others [‘Labour Tribunal’ Case]

Writ Petition No. 6448 of 2008

High Court Division of the Supreme Court of Bangladesh

Facts:
BLAST, along with another human rights organization, filed a writ petition on 25.08.2008 challenging the inaction of the Government and failure to establish Labour Tribunals and Labour Appellate Tribunals in Export Processing Zones (EPZ) under Sections 55 and 59 of EPZ Workers Association and Industrial Relations Act, 2004.

Arguments: The petitioners argued that in the absence of an effective forum for settlement of disputes the workers in the EPZ were denied access to justice.

Order: The High Court directed the respondents to show cause for their failure to give effect to Sections 55 and 59 of the 2004 Act and to establish a Labour Tribunal and Labour Appellate Tribunal in the EPZ by way of gazette notification.

Laws Cited: EPZ Workers Association and Industrial Relations Act, 2004

Status: Pending hearing
